1. Eligibility and Authority
You must be at least 18 years old and legally capable of entering into a binding contract to request a quote, submit any booking or inquiry form, create an account, or reserve services. A minor may ride only when the reservation is made by an adult who accepts responsibility for the minor and all applicable child-restraint requirements. We may decline or cancel a request if age, identity, authority, payment information, or other required details cannot be verified.
2. Nature of Our Services
Houston 365 is a chauffeured transportation service provider and transportation arranger. Depending on availability and location, a trip may be performed by Houston 365, an affiliate, or an independently owned and operated transportation provider or chauffeur (“Service Provider”). Vehicles shown on the Site are examples; make, model, color, capacity, amenities, and appearance are not guaranteed unless expressly confirmed in writing. We may substitute a comparable or higher-category vehicle when reasonably necessary. Nothing in these Terms creates an employment, partnership, joint-venture, or agency relationship between Houston 365 and an independent Service Provider.
3. Quotes, Reservations, and Confirmation
A quote is an estimate, not a guaranteed reservation or final price. A reservation is accepted only when Houston 365 issues a written confirmation or reservation number and any required deposit or payment authorization has been received. The customer must review the confirmation immediately and report errors. The customer is responsible for accurate passenger count, luggage, accessibility needs, child-seat needs, pickup instructions, flight or vessel details, itinerary, contact information, and timing. Service is subject to vehicle and chauffeur availability, lawful operating conditions, and acceptance by Houston 365.
Changes are effective only when accepted and confirmed by Houston 365 in writing. A changed pickup time, date, location, itinerary, vehicle, passenger count, or service type may be treated as a new reservation and may change the price or cancellation deadline. We may refuse requests that are unsafe, unlawful, impracticable, outside the confirmed scope, or inconsistent with vehicle capacity.
4. Prices, Payment Authorization, and Additional Charges
Published rates and quotes may change before confirmation. Unless a written confirmation states that a price is fixed and all-inclusive, quoted amounts are estimates. The customer authorizes Houston 365 to charge the payment method provided for the base fare, deposit, cancellation or no-show fees, waiting time, overtime, extra stops, route or schedule changes, parking, tolls, airport or port charges, meet-and-greet fees, cleaning or damage, administrative or service charges, taxes, and other amounts incurred in connection with the reservation. Final charges may be processed after service is completed.
Services are billed to the card provided or an approved account. We may require advance payment, a deposit, or a card authorization hold.
Hourly and event service is billed at the confirmed hourly or package rate. Partial hours may be rounded up to the next half-hour, subject to any confirmed minimum.
Houston 365 does not charge, collect, include, or require chauffeur tips or gratuities. Tipping is entirely at the passenger’s sole discretion, based on satisfaction with the chauffeur’s service, and may be paid directly to the chauffeur. Any tip is a private transaction between the passenger and chauffeur. Houston 365 does not receive, administer, refund, account for, or accept responsibility or liability for such tips.
For international service, local-currency costs may be converted to U.S. dollars using the exchange rate applied by Houston 365 or its processor when charged.
The customer is responsible for chargebacks or disputed-payment costs to the extent permitted by law when the underlying charge is valid.
5. Cancellations, Changes, and No-Shows
The specific cancellation terms shown in the written confirmation control if they differ from this section. Unless the confirmation states otherwise:
Sedan or SUV transfer and airport service: cancellation or material change less than 2 hours before the scheduled pickup is charged at 100% of the confirmed estimated fare.
Hourly or event service using a sedan, SUV, or van: cancellation or material change less than 24 hours before pickup is charged at 100% of the confirmed estimated fare.
Stretch limousine, passenger van, minibus, or motor coach service: cancellation or material change less than 7 calendar days before pickup is charged at 100% of the confirmed estimated fare.
Special events, peak dates, multi-day programs, group movements, affiliate service, and custom arrangements may be nonrefundable or subject to different deadlines stated in the confirmation.
A “No-Show” occurs when the passenger cannot be located at the confirmed pickup point, does not respond using the contact information provided, and does not contact Houston 365 within the applicable wait period or, if no period is stated, within 60 minutes after the scheduled pickup. A No-Show may be charged the full estimated fare, applicable waiting time, parking, tolls, service charges, and other incurred costs. Airport grace periods, flight monitoring, and pickup procedures vary by airport and service type and will be applied as stated in the confirmation or dispatch instructions. If you cannot locate the chauffeur or vehicle, call +1-713-804-6600 immediately.
6. Passenger Conduct, Safety, and Vehicle Rules
Passengers must follow applicable law and reasonable safety instructions from the chauffeur or Service Provider. Seat belts must be used where available. The customer is responsible for passengers and guests in the customer’s party. Unless expressly approved in writing and lawful, the following are prohibited: smoking or vaping; illegal drugs; open alcohol; weapons; disorderly, threatening, abusive, discriminatory, or unsafe conduct; standing while a vehicle is moving; exceeding vehicle capacity; and conduct that distracts or obstructs the chauffeur. The chauffeur may refuse, suspend, or terminate service without refund when conduct is unsafe, unlawful, abusive, destructive, or materially disruptive. Law enforcement may be contacted when appropriate.
The customer is responsible for repair, replacement, specialized cleaning, downtime, and related losses caused by the customer’s party, including spills, smoking, burns, excessive mess, sickness, or damage to the vehicle. Houston 365 may charge the authorized payment method for documented costs, subject to applicable law.
7. Children, Accessibility, Animals, and Luggage
The booking party must disclose child passengers and provide or request legally required child restraints in advance. Availability is not guaranteed unless confirmed. Passengers must install and secure any customer-provided child seat unless applicable law requires otherwise. Accessibility needs, mobility devices, service animals, pets, oversized items, and unusual luggage must be disclosed before confirmation so suitable service can be evaluated. Service animals are accommodated as required by law. Houston 365 may decline items or animals that cannot be transported safely or lawfully.
8. Delays, Routes, and Events Beyond Our Control
Pickup and arrival times are estimates and are not guaranteed. Houston 365 and Service Providers are not responsible for delay, missed flights or connections, or failure to perform caused by circumstances beyond reasonable control, including traffic, weather, road closures, accidents, mechanical failure, governmental action, security restrictions, airport or port congestion, labor disruption, public emergency, acts of God, telecommunications failure, or passenger delay. We may alter the route, vehicle, chauffeur, pickup procedure, or Service Provider for safety, operational, or legal reasons. If service cannot be completed, our responsibility is limited as stated in Section 12, except where prohibited by law.
9. Flight, Airport, Port, and Event Information
The customer must provide accurate airline, flight number, airport, terminal, arrival time, vessel, cruise terminal, event, and pickup details. Houston 365 may monitor publicly available flight information as a convenience but does not guarantee accuracy. The customer remains responsible for notifying us promptly of diversions, cancellations, terminal changes, missed connections, or schedule changes. Airport, port, venue, and security rules may change pickup locations and procedures.
10. Communications and Electronic Records
By providing a phone number or email address, you authorize Houston 365 and service providers acting for us to contact you about quotes, reservations, account activity, payment, pickup coordination, service updates, and customer support by call, email, or text message. Consent to receive operational messages is part of fulfilling your request and is not consent to receive marketing. Marketing messages will be sent only as permitted by law and any consent you provide. Message and data rates may apply. You may opt out of marketing texts by replying STOP and request email opt-out through the unsubscribe method provided, but you may still receive non-marketing communications needed to administer an active reservation or account. Electronic confirmations, notices, and signatures have the same effect as paper records to the extent permitted by law.
11. Lost, Delayed, or Damaged Property
Passengers are responsible for baggage and personal property. Houston 365 will make reasonable efforts to locate reported items, but does not accept custody of property and is not liable for loss, theft, delay, or damage except to the extent caused by liability that cannot lawfully be excluded. Items found may be held for a limited period and may be returned at the owner’s cost. Do not place valuables, medication, travel documents, or fragile items in unattended luggage compartments.
12. Disclaimers and Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE, QUOTES, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” HOUSTON 365 DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT TO THE EXTENT A WARRANTY CANNOT LEGALLY BE DISCLAIMED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOUSTON 365, ITS OWNERS, EMPLOYEES, AFFILIATES, SERVICE PROVIDERS, AND CHAUFFEURS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOST PROFITS, REVENUE, BUSINESS, DATA, OR OPPORTUNITY; OR MISSED FLIGHTS, CONNECTIONS, CRUISES, EVENTS, OR APPOINTMENTS, EVEN IF ADVISED OF THE POSSIBILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGGREGATE LIABILITY ARISING FROM A RESERVATION OR SERVICE WILL NOT EXCEED THE AMOUNT PAID OR PAYABLE TO HOUSTON 365 FOR THE SPECIFIC RESERVATION GIVING RISE TO THE CLAIM.
These exclusions and limits do not apply to liability that cannot be waived or limited under applicable law, including liability finally determined to result from gross negligence, willful misconduct, or another non-waivable basis. Each limitation is intended to be severable and apply regardless of the legal theory asserted.
13. Customer Indemnification
To the maximum extent permitted by law, the customer agrees to defend, indemnify, and hold harmless Houston 365, its owners, employees, affiliates, and Service Providers from third-party claims, losses, liabilities, fines, penalties, damages, and reasonable legal fees arising from: (a) the customer’s or passenger’s breach of these Terms; (b) unlawful, unsafe, or wrongful conduct by the customer’s party; (c) inaccurate information or unauthorized booking or payment; or (d) damage to a vehicle or injury caused by the customer’s party, except to the extent caused by the indemnitee’s negligence or other conduct for which indemnification is prohibited by law.
14. Claims and Notice
To help us investigate, service complaints, lost-property reports, billing disputes, and damage claims should be submitted promptly to info@houston365.net with the reservation number and supporting information. Nothing in this section shortens a legal limitations period or waives rights where such a restriction is prohibited by law. Failure to provide prompt notice may limit recovery to the extent the delay materially prejudices investigation or mitigation.
15. Governing Law and Dispute Resolution
These Terms and any dispute are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Before filing a claim, the parties will make a good-faith effort for at least 30 days to resolve the matter after written notice describing the dispute and requested relief is sent to the contact address below. Unless applicable law requires otherwise, exclusive jurisdiction and venue for any court proceeding will lie in the state or federal courts serving Harris County, Texas, and each party consents to that jurisdiction and venue. EACH PARTY WAIVES A JURY TRIAL TO THE MAXIMUM EXTENT PERMITTED BY LAW. Nothing prevents either party from seeking temporary injunctive relief or bringing an eligible individual claim in small-claims court.
16. Website Use and Intellectual Property
The Site and its text, design, graphics, logos, software, and content are owned by or licensed to Houston 365 and protected by law. You may use the Site only for lawful personal or internal business purposes related to evaluating or obtaining our services. You may not interfere with the Site, access it by automated means without permission, introduce malicious code, scrape or copy substantial content, impersonate another person, submit false information, or use the Site to violate law or another person’s rights. Third-party links and services are provided for convenience; Houston 365 does not control or endorse them and their terms may apply.
17. Privacy
Our separate Privacy Policy explains how we collect, use, disclose, and protect personal information. It is incorporated into these Terms by reference but is presented separately on the Site.
18. Changes, Severability, Waiver, and Entire Agreement
We may update these Terms by posting the revised version with a new effective date. Changes apply prospectively unless law permits otherwise. The Terms in effect when a reservation is confirmed generally govern that reservation, except changes required by law or expressly accepted by the customer. If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remainder will continue. A failure to enforce a provision is not a waiver. These Terms, the written confirmation, applicable account agreement, and any written special terms form the entire agreement concerning the service. If they conflict, the written confirmation or signed account agreement controls for the specific reservation.
